and Conditions of Service

This document describes the obligations and
responsibilities that go along with owning
your Internet account. Please note that by
using Cyberspeedway Internet Service Port,
you agree to abide by the rules set forth below
and by other rules as may be deemed necessary.
We reserve the right to cancel or refuse service
to anyone that does not comply with these terms
and conditions. If you have any questions,
please contact our office.
1. Privacy. Cyberspeedway
(CS) has every intention of keeping all aspects
of your account private. We do no and will
not ever sell your private information to other
parties. It is not possible for us to guarantee
the privacy of your Internet activity while
using our service. By using data encryption
you can increase your level of privacy. You
are responsible for taking all precautions
you find necessary to protect your private
information while using the Internet.
2. Responsibility. You are
responsible for all actions taken on the Internet
through the use of your CS account. Choosing
and maintaining a good password is part of
this responsibility. Cyberspeedway, it's Owner
and employees are not, individually or separately,
liable for any actual or imagined harm that
is connected in any way with the use of your
account on the Internet. You are responsible
for all access and usage on your account. You
are responsible for verifying the cancellation
of your account (see Account Changes or Closure
below); periods of inactivity do not constitute
account cancellation. Cyberspeedway provides
you with the ability to access the Internet,
but is not responsible for your ability to
access a specific connection, browse the Internet
or send/receive email through an independent
mail client (e.g. Microsoft Outlook Express),
as these services are provided by software
and/or companies not affiliated or associated
with Cyberspeedway.
3. Unlawful Activity. While
using this Network Access Port, you will have
access to connections and websites that are
specifically illegal as defined by various
local, state and federal laws. You are singularly
responsible for your use, and that of others
who use your account. Subscribers who violate
any local, state, or federal law will have
their account terminated without recourse.
As is necessary, proper authorities will be
notified if these activities come to our attention.
4. Pornography and Obscene Material. The
Internet is a free media and contains numerous
sites that contain pornographic and obscene
material. You are in complete control as to
those sites that you or, anyone you allow to
use your account, may access. There are some
software solutions available to you for filtering
objectionable materials. If you become involved
in this aspect of the Internet, be aware that
there are local, state & federal laws that
do apply to certain types of pornographic materials.
You are responsible for your own compliance
with the applicable laws governing this area.
5. Net Etiquette. To keep
from offending others, it is important to learn
proper Net Etiquette. Abuses of net etiquette
can result in you and the system administrator
being flooded with mail from around the world
(Mail Bombs). You are prohibited from spamming
(sending mass, unsolicited e-mails) the system
or any newsgroup servers. CS tracks network
abuse and shares information on system abusers
with other providers of Internet services.
A spamming violation can result in termination
without recourse and/or charges for any tech
time required to remedy any retaliatory action
by injured parties. Complaints from other users
will be dealt with on a case-by-case basis.
6.
Account Payment. Your
payment is due by the 11th of the month of
your respective billing cycle. There will be
a $5.00 late fee for balances left unpaid after
the 11th of the month. Accounts with a past
due balance will be disabled for non-payment.
An account disabled for more than 10 days will
be deleted and will require payment of any
old balance and a new setup fee to be re-established.
There is a $25.00 returned check fee charged
for each NSF item, disputed credit card charge
and/or charge backs. Any account that is deleted
and unpaid for more than 30 days will be sent
to collections and will be assessed an additional
$25 Collection Fee.
7. Age Limit. Users under
18 years of age may not access this service
without parental approval.
8. Account Changes or Closure. Cancellation
notices may be given over the phone, via fax
or U.S. Mail. You are responsible for verifying
the receipt of any cancellation notice. At
least thirty days notice is required for account
closure. Account closure and cancellations
will occur on the last day of the respective
billing cycle; no pro-rating is available.
For example: an account cancellation notice
that is received on the 15 th of the month
will close the account at the end of the following
month. Account changes require 15-day prior
notice.
9. Business Activity: You
may not use a personal account for business
activity including but not limited to selling/advertising
on a web page for financial gain.
10. Shared Modem Requirements: A
dialup account is not a dedicated (24-hour)
connection. Users may be disconnected after
15 minutes of inactivity. Users must have at
least one 30-minute logoff period after each
7½ hours of continuous use. Any accounts
in violation of the 30-minute logoff condition
will be charged for a dedicated (24-hour) connection.
. Any account that is logged in for a continuous
24 hours in any 27-hour period may be disconnected
and disabled for a 3-hour penalty period.
